These terms describe how ProtectMyi provides the free pilot and handles information supplied by or collected from your IBM i systems. “You” means the organization using ProtectMyi; “Customer Data” includes IBM i telemetry, configuration, system identifiers, events, and other information submitted through the service.
1. Free pilot
The service is currently offered as a free pilot without a per-organization LPAR cap. No payment method is required, and no billing will occur during the pilot. We will use the primary contact details you provide for account and service communications, including notice of pilot changes or its eventual end. Those details may differ from the email used to sign in. We will explain any future paid offering and require your affirmative choice before charging you. Pilot features may change as we develop the service.
2. Your data and our limited permission to use it
You retain ownership and control of your Customer Data. You give ProtectMyi permission to receive, store, process, display, and transmit that data only as needed to provide, maintain, secure, troubleshoot, and improve the service and to comply with applicable law. You are responsible for having the authority to connect your systems and provide the data you submit.
3. Technical analysis and access
We may review Customer Data when reasonably necessary to diagnose problems, investigate security or service issues, validate monitoring results, plan cloud storage and processing capacity, forecast data growth, and improve the reliability and performance of ProtectMyi. Access is limited to people and service providers who need it for those purposes. We will use aggregated or de-identified information where it is sufficient for the task.
We do not use Customer Data or business contact details for advertising, customer testimonials, sales targeting, or other marketing purposes, and we do not sell them. A new purpose outside these technical and service purposes would require a separate notice and any consent required by law.
4. How we organize your data
We may change schemas, transform formats, reorganize records, move data between tables or collections, create indexes, and migrate storage systems to maintain or improve the service. These technical changes do not transfer ownership of your data to us. We will preserve applicable access controls and the regional commitments below when making these changes.
5. Data location
Detailed IBM i telemetry is stored and processed in the Canadian or U.S. regional environment assigned to the LPAR. ProtectMyi also operates a shared control system, separate from that regional environment, that stores account and organization details, LPAR identifiers, registration information, and current health data. A telemetry region selection therefore does not currently keep every item of account and service data exclusively in that country. We will not move detailed telemetry to the other country's regional environment merely as part of a table or storage migration.
Infrastructure providers may process limited service and security information as part of operating the service. Where laws require disclosure, information may be subject to lawful access in the jurisdiction where it is held. Contact us before connecting a system if your organization requires every category of data to remain exclusively in one country.
6. Confidentiality and security
We treat Customer Data as confidential and use reasonable technical and organizational safeguards appropriate to the data and the pilot service. We may use cloud service providers to host and operate ProtectMyi, subject to obligations that protect the data. You should not submit information that your organization is prohibited from placing in this service.
7. Account access and ending use
You are responsible for your users' access and for keeping account credentials secure. You may stop using the pilot and request access to, export of, or deletion of your Customer Data. We will respond in accordance with applicable law and our technical capabilities, subject to records we must retain for security, legal, or operational reasons. We will give notice of material changes to these terms before they take effect for existing customers.
8. Supplemental service and your operational responsibility
ProtectMyi provides monitoring, notifications, an IBM i agent and installer, and any remote actions you authorize. It does not operate, administer, insure, or guarantee the safety, security, availability, or recovery of your IBM i systems. You remain responsible for your systems, configurations, credentials, backups, independent monitoring, incident response, disaster recovery, and decisions about whether and how to act on a finding or alert.
Alerts may be delayed, inaccurate, missed, or not delivered. A problem may not be detected, and an alert may not be seen or acted on by the right person. Do not rely on ProtectMyi as your sole means of detecting or responding to an operational or security issue. Before running the installer or approving an action, ensure you have appropriate authorization and a suitable backup and recovery plan.
9. Pilot service disclaimer
The pilot is provided “as is” and “as available.” To the fullest extent permitted by applicable law, ProtectMyi disclaims warranties and conditions, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, and uninterrupted, error-free, or secure operation. We do not promise that a bug, interruption, missed alert, installer action, or agent behavior cannot affect your systems or data.
10. Limitation of liability
To the fullest extent permitted by applicable law, ProtectMyi and its operators, personnel, and service providers are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, business, goodwill, data, or use, business interruption, or costs of substitute services, even if advised such losses were possible. This includes losses associated with an undetected issue, a delayed, incorrect, or missed alert, a failure to respond to an alert, a software defect, an installer or agent problem, an authorized remote action, or a system outage or crash.
For all other claims arising from or relating to the free pilot, the total aggregate liability of ProtectMyi and its operators and personnel, across all claims and legal theories, is limited to CAD $100. This cap applies to direct damages, including those arising from a bug or service failure. It does not limit liability for fraud, deliberate misconduct, or any liability that applicable law does not permit us to exclude or limit. No provision prevents a party from bringing a claim in a court with jurisdiction; the exclusions and cap govern the remedies available to the extent enforceable.
11. Customer indemnity
You will defend and indemnify ProtectMyi and its operators and personnel against reasonable losses, judgments, and legal costs arising from a third-party claim caused by your unauthorized connection of a system, your unlawful or unauthorized Customer Data, your breach of these terms, or actions you direct or approve on a system. This obligation does not apply to the extent the claim was caused by ProtectMyi's own negligence, breach of these terms, or other wrongful conduct. We will promptly notify you of a claim, reasonably cooperate in its defense, and not agree to a settlement that imposes an obligation on you without your consent.
12. Agreement and changes
The person accepting these terms confirms they are authorized to bind the organization. Acceptance is recorded with the terms version, account, user, and time. These terms apply to the free pilot; a future paid plan will require a separate affirmative choice. If a material change to these terms requires renewed acceptance, we will request it before applying the changed terms to existing customers. If a provision cannot be enforced, the remaining provisions continue to apply to the extent permitted by law.
